Looking For Cheaper Alternative To Resolve Public Records Disputes

According to the announcement by Washington State Attorney General Rob McKenna, recently his office together with the Washington State Auditor initiated the creation of a special twenty member task force meant to work out recommendations that would facilitate the ways and means the general public within the jurisdiction might resort to in order to ensure better access to the information contained in public records stored by different government agencies.
The task force will also see how ordinary citizens could better exploit the benefits provided to the community by the Open Public Meetings Act. In the Attorney General’s opinion the progress could be achieved, if a specialized administrative board were created with powers to resolve disputes and see to the complaints over the instances involving violations of the provisions of the Public Records and the Open Public Meetings Acts. The said administrative board is being thought of as an institution that could provide alternative to filing public records lawsuit with a state or a local court.
Many public activists and lawmakers believe that setting up the administrative board to deal with public records disputes at the initial level would be beneficial to both state and local governments and people from all walks of life, because litigation process often turns out lengthy and expensive as it incurs attorney fees that are being paid from state or counties budget when a case is decided in favor of plaintiff from one hand, or which many potential plaintiffs just can’t afford as the initial investment in spite of their desire to defend their right for accessing the information the law makes them entitled to access at no cost.
The categories of the population that are especially concerned about guaranteed free access to the records are small businessmen, small landlords etc. who often use inspecting public records as an alternative to ordering an expensive background check they might need in process of hiring a new employee or renting their property.
