States Enforce Auto Insurance Laws

Individual states are in charge of the auto insurance laws in their particular state. You will find that from state to state most guidelines will be the same. There will however, be many differences as well. You may find in one state that it is okay to talk while holding your cell phone only to cross over state lines and be informed by the highway patrol that you are getting a ticket for not using a hands free device.
The federal government can put rules into place. If congress, the senate and the President feel that it in the best interest of America to institute a new driving or insurance rule then they can choose to enact it.
For insurance laws the federal government tends to stay out of it. They will pass laws that have to do with road safety though. These laws can directly affect an auto policy. Car insurance companies will be required to change current policies should the government implement any law that they were not already following.
In many states you will find that not having at least liability insurance is against the law. If you get pulled over without insurance then the authorities can take your car and impound it until you can show proof of insurance. At that point you will have to pay the impound fees, the insurance fees and the fees associated with the ticket. It is worth it just to get the liability insurance that the state requires.
Many officers will give you what is called a fix a ticket and give you the opportunity to show the courts proof that you do have insurance. That way you can keep your car and send a much smaller fee in the mail along with a copy of your insurance certificate.
